La sanción de esta ley superior fue llevada adelante por una Convención Constituyente reunida en Santa Fe.
La constitución fue aprobada con el apoyo general de los gobiernos provinciales, con la importante excepción de Buenos Aires, que se separó de hecho de la Confederación Argentina hasta 1859.
